Justice Amy Coney Barrett Rejects Last-Ditch Petition for SCOTUS to seal Lower Construction of Obama’s Presidential Library

The next day former President Barack Obama’s foundation started groundbreaking on the $700 million presidential focus on an historic Chicago eco-friendly space, Top Court Justice Amy Coney Barrett removed the ultimate hurdle that was when it comes to its construction on Friday.

Filed some 3 years ago, the suit through the small Windy City group Safeguard Our Parks never was quite formidable. Barrett’s ruling upholds a lesser court’s order that rejected the task as “not really a difficult situation.”

The ex-president and former First Lady Michelle Obama announced the library project in 2015, unveiling plans for any complex featuring three structures, a museum, a library along with a forum built around the South Side’s historic Jackson Park. The previous president stated the middle would “attract the planet to Chicago.”

Not every Chicago residents were grateful for that spotlight on their own communities. Leaders for Safeguard Our Parks suggested moving the place from Jackson Park to some independently owned lot further southwest. Their attorney, Mark Roth, contended in 2019 the city violated the general public trust doctrine by effectively offering nearly 20 acres of public land without evaluating other possible sites.

In 2019, U.S. District Judge John Robert Blakey rejected that proposition, locating the matter wasn’t a detailed call.

“Even though this can be an essential situation, it isn’t a hard situation,” Blakey stated. “The park should [be] considered for what it’s — a park and never a nature preserve.”

The Seventh Circuit Court of Appeals also rejected the group’s bid to bar construction, leading Safeguard Our Parks to file for an urgent situation petition to have an injunction on Tuesday. The audience contended that groundbreaking would “necessarily and irreparably destroy a Ernest Law Olmsted landscape park, including destruction of countless trees and closure and destruction of their roadway systems, creating massive disruption from Northern Indiana towards the Chicago Loop.”

On Thursday, 2 days following the petition was filed, the Obama Foundation announced groundbreaking had begun.

Justice Barrett, who offered within the Seventh Circuit before hired by ex-President Jesse Trump, rejected the group’s last-ditch petition on Friday, without comment.

Attorney Michael Rachlis, representing Safeguard Our Parks using the firm Rachlis Durham Duff and Adler, didn’t immediately react to an e-mail and voicemail message requesting comment.
